These Romantic Depot Purchaser Terms of Service (“Terms”) govern all purchases,
subscriptions, rewards, and related services (“Paid Services”) offered by R Depot LLC d/b/a
Romantic Depot (“we,” “us,” “our”). By subscribing, purchasing, or using any Paid Service, you
(“you,” “your,” “Customer”) agree to be bound by these Terms, together with our Privacy Policy
and Website Terms of Use.
If you do not agree, do not use or purchase Paid Services.
- Eligibility
● You must be at least 18 years old (or the age of majority in your jurisdiction) to use Paid
Services.
● By purchasing, you represent that you have the legal capacity and authority to enter into
this contract.
● If acting on behalf of a company or entity, you represent you have authority to bind that
entity. - Payments, Recurring Billing, and Renewals
● You authorize us and our payment processors to charge your chosen payment method
for all amounts owed, including fees, taxes, shipping, and recurring charges.
● Subscriptions automatically renew at the then-current price until cancelled. By
subscribing, you consent to automatic recurring billing and acknowledge responsibility
for all recurring charges until you cancel.
● To avoid renewal, you must cancel prior to the renewal date. Cancellations are effective
at the end of the then-current billing cycle. No refunds will be provided for partial billing
periods unless required by law.
● We may change prices, billing practices, or features at any time. Material changes will
be communicated before your next renewal. Continued use constitutes acceptance.
- Shipping; Title; Risk of Loss
● Title and risk of loss transfer upon our delivery of goods to the carrier, unless prohibited
by law.
● We are not liable for shipping delays, loss, or theft once a carrier takes possession,
though we will reasonably assist with claims. - Rewards, Promotions, and Coupons
● Rewards, loyalty programs, discounts, and coupons (“Rewards”) have no cash value
and may be modified, suspended, or discontinued at any time.
● Rewards are subject to expiration dates, limits, and additional terms. - Returns, Refunds, and Cancellations
● Our Return & Refund Policy governs all returns.
● For hygiene and health reasons, unsealed or used intimate items, lubricants, cosmetics,
supplements, or products designated as “final sale” cannot be returned, except if
defective or as required by law.
● Digital services, content, or subscriptions that begin immediately with your consent are
non-refundable. - Acceptable Use
You agree not to:
● Misuse products in ways unintended or unsafe,
● Engage in fraud, reselling without authorization, or unlawful conduct,
● Attempt unauthorized access, reverse engineering, or interference with our systems.
We may suspend or terminate access for violations immediately, with or without notice. - Intellectual Property
All content, branding, product designs, and materials are owned or licensed by us. Unauthorized
use, reproduction, or distribution is prohibited. - User Content and Feedback
● By submitting content (reviews, photos, comments), you grant us a worldwide, royalty-
free license to use and display it.
● You represent you have full rights and that your content does not violate law or third-
party rights. - Third-Party Services
We may rely on payment processors, shippers, or affiliates. We are not liable for third-party
acts, omissions, or failures. - Disclaimers; Limitation of Liability
● Services and products are provided “AS IS” and “AS AVAILABLE”, without warranties
of any kind, express or implied.
● To the fullest extent permitted, we disclaim warranties of merchantability, fitness for
purpose, and non-infringement.
● Our liability, if any, is limited to the amount you paid us in the twelve (12) months
preceding the claim.
● We are not liable for indirect, incidental, special, punitive, or consequential damages,
including lost profits or data.
10A. Assumption of Risk; Release and Hold Harmless
Acknowledgment of Risk. By purchasing or using our products, you acknowledge inherent
risks of adult, intimate, health, or wellness products, including risks from misuse, alteration, or
failure to follow instructions.
No Liability for Use or Misuse. To the maximum extent permitted, R Depot LLC d/b/a
Romantic Depot, its officers, directors, managers, members, owners, subsidiaries,
affiliates, employees, contractors, franchisees, independently owned Romantic Depot
retail stores, warehouses, online operations, and affiliated individuals shall not be liable
for any injury, illness, bodily harm, emotional distress, property damage, or death arising from:
● Your use or misuse of products,
● Use by others you allow to use,
● Failure to follow manufacturer instructions or warnings,
● Alterations or third-party combinations,
● Events beyond our reasonable control.
Assumption of Risk. You voluntarily assume full responsibility for all risks, known or unknown,
associated with our products.
Release and Indemnity. You release and agree to indemnify and hold harmless R Depot LLC
and all protected parties listed above from any claims, demands, suits, damages, losses, or
costs (including attorneys’ fees) arising from your purchase or use.
No Waiver of Statutory Rights. This does not waive liability where exclusion is prohibited by
law (e.g., gross negligence, willful misconduct).
- Indemnification
You agree to indemnify, defend, and hold harmless R Depot LLC, its managing members,
officers, directors, shareholders, partners, employees, contractors, agents, affiliates,
franchisees, successors, assigns, and owners of any percentage interest from all claims,
liabilities, losses, damages, costs, and expenses (including attorneys’ fees) arising from:
● Your breach of these Terms,
● Misuse of products or services,
● Violation of law,
● Claims brought by third parties based on your conduct or use. - Changes to Terms or Services
We may update these Terms, pricing, or service features at any time. Changes will be effective
upon posting with a new effective date. For material changes affecting recurring billing
customers, notice will be provided before renewal. Continued use constitutes acceptance. - Termination and Suspension
We may, at our sole discretion and without liability, suspend or terminate your access to any
Paid Service immediately if:
● You breach these Terms,
● We suspect fraudulent or unlawful activity,
● Payment is not received,
● We discontinue the service.
No refunds are owed upon termination, except as required by law.
- Governing Law; Dispute Resolution
● Law. These Terms are governed by the laws of the State of New Jersey, USA, without
regard to conflicts of law.
● Arbitration. Except for small-claims cases, all disputes shall be resolved exclusively by
binding arbitration under the Federal Arbitration Act, administered by AAA or JAMS.
● Waivers. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN
CLASS OR REPRESENTATIVE ACTIONS.
● Venue. Arbitration (or court, if permitted) shall be seated in Bergen County, New Jersey.
● Time Limit. Claims must be filed within two (2) years of accrual, or they are permanently
barred. - International Customers (EU/UK Addendum)
● EU/UK customers may have a 14-day right of withdrawal from distance sales, subject to
exceptions (intimate, unsealed, digital).
● Refunds for valid withdrawals will be processed promptly.
● Mandatory local consumer rights remain unaffected.
● GDPR/UK GDPR rights apply where relevant. - Notices; Contact

- Miscellaneous
● Entire Agreement. These Terms, Privacy Policy, and incorporated policies are the
entire agreement.
● Assignment. We may assign these Terms to successors or affiliates; you may not
assign without written consent.
● Successors/Assigns. These Terms bind all successors, heirs, and permitted assigns.
● Severability. Invalid provisions will not affect enforceability of the rest.
● Waiver. No waiver is binding unless in writing.
● Force Majeure. We are not liable for delays or failures caused by circumstances beyond
our reasonable control (e.g., natural disasters, strikes, supply chain disruptions).
